Summary:
The WYPDES database records indicate Superior has submitted quarterly Discharge Monitoring Reports (DMRs) which reported effluent exceedances of E-coli dating back to 2009. The WDEQ-WQD has issued multiple Letters of Violation for these recurring effluent violations dating back to April, 2009. Since that time there have been regular exceedances of permit limits for E-Coli. The WQD issued NOV Docket No. 4678-10 on April 28, 2010 for recurring exceedances of E-coli, numerous missed samples, and reporting errors on dicharge monitoring reports which are violations of WYPDES permit conditions. The actions taken by the town in response to the past enforcement actions have not been successful in achieving consistent compliance.
