THE MEETING WILL BE HELD in Cheyenne WY in the Elk Room, Game and Fish Commission, 5400 Bishop Boulevard, The meeting will convene at 9:00 a.m.
The agenda may be amended at anytime, up to 24 hours prior to the meeting. Emergency items can be added at any time. Agenda items that do not have a specific time indicated can be taken up by the Council at any time.

Brook Mining Company LLC could not obtain consent from two surface owners of land involved in their permit to mine coal. Brook filed a petition with the Council for an Order in Lieu of Consent.

In Re Patriot Energy Resources LLC
Docket 16-3501
Patriot Energy Resources purchased numerous CBM wells from previous developers. Patriot was granted the transfer of those CBM wells and posted a bond for them. The CBM wells have been idle for 2 years or more and Patriot has not taken any steps to reclaim the reservoirs associated with those wells and the bond. DEQ has filed the necessary paperwork to forfeit the bond.
In Re Red Desert Gravel

The operator, Red Desert Gravel, is no longer licensed to do business in Wyoming and the minerals leases have expired for each operation. I have therefore determined that the three reclamation performance bonds posted by Red Desert Gravel/Mr. Jim Wise should be forfeited at this time. I have determined that the bond for these LMO Permits Red Desert Gravel (Mr. Jim Wise, Agent), 1305ET, 1358ET, and Jim Wise 1276ET should be forfeited.

1:30 p.m. Sept. 28 In Re Big Valley and Crossed Arrows
Docket 16-3601
BVCA appealed the decision of the WQDEQ that BVCA was responsible for the sewer system at the Crossed Arrows mobile home park. The WQD identified the sewer system as a risk for cross contamination of the potable water supply system of the BVCA.

Immediately following the Big Valley Crossed Arrows contested case hearing.
CASE UPDATES

Dave's Asphalt appealed this NOV and Order stating that the State does not have jurisdiction on the Wind River Reservation.
