ADMINISTRATIVE ORDER ON CONSENT
City of Sundance
The current permit for the City of Sundance Municipal Landfill expired on August 10, 2010. The permit was issued with the condition that a renewal or closure permit application was to be submitted no later than December 1, 2009. A permit application has not yet been submitted. Operating without a permit is a violation. The City and the DEQ have met to discuss alternatives and their consequences; however at this time the City has not completely finalized its future waste management plans and needs additional time in which to do so.
Town of Kaycee
The current operating permit for the Kaycee landfill expired on 2-1-11 and has been in the process of being renwed since 6-16-10. The facility has been disposing of waste outside the permitted facility boundary. The Town plans to cease disposal in the landfill within the next several years. Toward that end the Town has permitted and constructed a transfer station for the management of solid waste. SWRR calls for submittal of a closure permit application containing the information required under Chapter 2 between 270 and 180 days prior to the anticipated facility closure. Because the facility has not yet established a date to close, a closure permit has not yet been submitted.
High Plains LLC Approval of Settlement Agreement and Dismissal
Bond forfeiture for coal bed methane reservoir reclamation: failure to submit the total required bond amount, failure to submit a required 3% annual bond increase since 2011, failure to respond to an Order by the EQC, and failure to reclaim numerous CBM containment reservoirs
