Summary:
Union Pacific Railroad Company ('Respondent') conducts business in the State of Wyoming. The Chicago North Western Railway (CNWR) was merged into the Respondent effective October 1, 1995, and is therebythe successor in interest to the CNWR. The Respondent is a person within the meaning of Chapter 1, Sect. 1 (f)(i) of the WDEQ Hazardous Waste Rules and Regulations.The tie treating activities at the former Facility may have resulted in the disposal of waste materials as defined in Chapter 1, Section 1(f)(i) of the WDEQ Hazardous Waste Rules and Regulations Although there is no evidence of spillsor leaks of waste materials during the term of CNWR ownership of the former facility and there are no official records of waste disposal at the former Facility, field investigation activities have identified soil and groundwater impacts that could be from materials historically used to treat ties (creosote and crude oil, zinc chloride).
